What it is

In València, activities with little environmental impact that do not need an environmental licence open with an environmental declaración responsable (Valencian Law 6/2014). First you must request the urban planning compatibility certificate: until it is favourable, or until one month has passed since the request, you cannot file the declaration (unless an OCA or collaborating body verifies compliance). This procedure is for premises with no works pending: any works must already be legalised in another file. Then you file the declaration with the project and the technical certificates. The City Council may carry out an inspection visit within one month; if it does not, you can open under your own responsibility after notifying the City Council. Harmless activities do not use this route, and retail shops of up to 750 m² do not need the prior planning report.

Steps

  1. Step 1: Check what type of activity it is

    Harmless activities (those meeting all the conditions in Annex III of Law 6/2014) do not file the environmental declaration but a notice of harmless activity, and they need the prior planning report. Retail shops of up to 750 m² of sales area do not need it.

  2. Step 2: Request the urban compatibility certificate

    The certificate shows that the project is compatible with urban planning. Until it is favourable, or until one month has passed since the request, you cannot file the declaration. It is not needed if you choose to have an OCA or a collaborating body registered with the Generalitat verify compliance (B1 certificate).

  3. Step 3: Submit the declaration

    On the e-office, filling in the form after clicking “Iniciar trámite”, or in person with the form, along with the documents. You must give the file in which the works were legalised.

  4. Step 4: Open

    The City Council may carry out an inspection visit within one month: if the result is favourable, the record allows you to open immediately; if there are deficiencies that can be fixed, you get a period to correct them. If there is no visit within one month of filing the complete declaration, you may open under your own responsibility, after notifying the City Council.

And if I need to do works on the premises?

This procedure is for premises with no prior works: the works must be legalised in another file; if they are not, they have to be legalised and this procedure cannot be used. For harmless activities and retail, works to set up the activity are processed together with the activity where possible.
